Website: www.veluxeai.com By accessing or using any of the services, content, or offerings from VeluxeAI (“we,” “us,” or “our”), you (“Client,” “User,” or “You”) agree to be bound by these Terms of Service. Please read them carefully.
1. Services Overview
VeluxeAI provides AI-powered automation, onboarding, and data intelligence systems for luxury real estate, finance, and wealth firms, including services like lead conversion, KYC automation, and pricing optimization. All services are customized and delivered as per client needs. We reserve the right to modify or enhance our services over time to improve functionality and client experience.
2. Use of Client Data
To deliver our services: We may access and use client-provided data (including PDFs, CRM exports, KYC forms, etc.). We may upload this data to third-party Large Language Models (LLMs), such as OpenAI, Grok, and others, as well as third-party applications (e.g., CRMs like Salesforce or Pipedrive, communication tools like WhatsApp), solely for the purpose of building, training, and running automation workflows. Client data, including sensitive lead/customer data, will be processed securely, used only for service fulfillment, and will not be sold, shared, or reused outside the client’s project scope. By using our services, you authorize us to use such data strictly within these bounds, as part of the service usage agreement, without requiring additional authorizations.
3. Data Privacy & Compliance
We are committed to following best practices aligned with global data privacy standards to protect client data. It is your responsibility to ensure the data you provide to us has been lawfully obtained and that you have obtained necessary consents from your end users, in compliance with all applicable privacy laws.
4. Intellectual Property
All source code, systems, and proprietary tools developed by VeluxeAI remain our intellectual property unless otherwise agreed in writing. Custom-built components for a client may be licensed for their exclusive use, not ownership, unless specified. Client data provided to us remains the property of the client and will not be used outside the scope of the agreed services.
5. No Guarantee of Results
While we aim to optimize your business operations and client engagement, we make no guarantees regarding revenue, lead conversions, or business outcomes. AI technologies are probabilistic by nature, and results may vary based on external factors beyond our control.
6. Limitation of Liability
VeluxeAI is not liable for: Any indirect, incidental, or consequential damages arising from the use of our services. Loss of data due to third-party platform issues, including third-party applications (e.g., Salesforce, WhatsApp) or Large Language Models (e.g., OpenAI, Grok). Errors in external APIs, CRM platforms, or LLM systems.
Total liability under any claim shall not exceed the fees paid by the client for the specific service in question.
7. Client Responsibilities
You agree to: Provide accurate and lawful data. Use our services only for lawful purposes. Ensure proper permissions and compliance for any third-party applications (e.g., Salesforce, WhatsApp) integrated with our services. Not reverse engineer or misuse any proprietary system provided by VeluxeAI.
8. Termination
We reserve the right to suspend or terminate services if: There is a breach of these terms. The client engages in fraudulent or unethical activity. Payments are delayed or disputed without resolution.
Upon termination, data handling will follow the retention and deletion policies outlined in our Privacy Policy.
9. Jurisdiction
These terms are governed by the laws of the United Arab Emirates, and any disputes shall be resolved in the courts of Dubai, unless otherwise mutually agreed.
10. Changes to These Terms
We may update these Terms of Service periodically. Clients will be notified of material changes via email or website updates at least 30 days before significant changes take effect. 11. Payment Terms
Clients agree to pay all fees as agreed upon during onboarding. Payments are due within 30 days of invoicing unless otherwise specified. Non-payment may result in service suspension or termination, as outlined in Section 8. All fees are non-refundable unless VeluxeAI fails to deliver the agreed-upon services due to its own fault.
12. Force Majeure
VeluxeAI shall not be liable for any delay or failure to perform its obligations under these Terms due to events beyond its reasonable control, including but not limited to natural disasters, cyberattacks, or governmental actions.
